Stability AI is a primary defendant in Andersen v. Stability AI et al., a class-action copyright lawsuit filed by visual artists in January 2023 alleging Stable Diffusion was trained on billions of scraped copyrighted images without consent. In August 2024, a federal judge allowed the artists' core copyright claims to proceed to discovery, finding it plausible that training on and distributing such models constitutes infringement. Stability AI has not admitted wrongdoing; Getty Images filed a separate copyright suit in 2023.
